When a person dies it is probably the most traumatic experience that a close relative can go through. It is a time when our advice and assistance is of great value. We work closely with you, advising as to practicalities as well as legalities, keeping you up to date and informed and so helping to ensure that everything proceeds as smoothly as possible at this stressful time.

If a person has left a valid Will then we help the Executors named in the Will need to obtain a Grant of Probate to carry out the deceased's wishes and administer the Estate.

If, however, there is no Will, the Estate has to be dealt with pursuant to the Intestacy Rules and in these cases we help to obtain a Grant of Letters of Administration and to deal with the administration of the Estate under the Rules.

In all cases the assets and liabilities of the deceased need to be ascertained so that a value of the Estate can be obtained. Depending on the value of the Estate, there may be a requirement for Inland Revenue Forms to be completed and sent to the Capital Taxes Office. There are some cases where an Inland Revenue Account is not required. An Oath also has to be formally sworn by the Executors/Administrators. We guide intending Executors and Administrators through the formalities and the forms.

How much would it cost?
This firm charges on a time spent basis. The Law Society Regulations allow a percentage of the value of the Estate to be charged. We at Gardner Austin consider it to be fairer to the client to charge only for the time spent in dealing with the matter. We keep our clients informed as to fees and can set limits on fees that will not then be exceeded without our clients consent.
